Do Not Pick Wildflowers

It is illegal to pick, collect, or remove native wildflowers from public lands, national parks, reserves, and road verges across all Australian states and territories.This includes taking cuttings, seeds, or any plant material. Please enjoy wildflowers by photographing them and leaving them undisturbed for others to appreciate.

State & Territory Legislation

Each Australian state and territory has specific legislation protecting native flora. Below is a summary of relevant laws:

New South Wales

Biodiversity Conservation Act 2016

Protects native plants on public land. Picking, damaging, or removing native plants without permission is an offence with penalties up to $220,000.

Flora and Fauna Guarantee Act 1988

Prohibits the taking, trading, keeping, moving or processing of listed taxa without authorisation. Penalties can reach $9,913 for individuals.

Nature Conservation Act 1992

Protected plants cannot be taken from the wild without a permit. Taking protected plants carries penalties up to $734,550 for endangered species.

2. Responsible Use

You agree to use this platform responsibly and in accordance with all applicable Australian federal, state, and territory laws regarding the protection of native flora. You must not use information from this site to locate and collect protected wildflowers.

3. Photo Uploads

By uploading photos, you confirm that: (a) the photos were taken without disturbing or damaging the wildflowers; (b) you have the right to share the images; and (c) the photos do not encourage illegal collection of protected species.

4. AI Identification Disclaimer

Our AI-powered identification is provided for informational purposes only and may not always be accurate. Do not rely solely on AI identification for scientific or legal purposes.

5. Conservation Commitment

WildflowerFinder is committed to the conservation of Australian native flora. We encourage all users to photograph responsibly, stay on designated paths, and report any illegal collection activities to local authorities.

6. Ownership & Copyright

WildflowerFinder, including its concept, design, branding, source code, database structure, AI integration methodology, user interface, and all original content is the exclusive intellectual property of Shades of April (ABN/ACN pending), owned and operated by April (hello@shadesofapril.com). All rights reserved © 2026.

7. Prohibited Activities

You may NOT, without express written permission from the owner:

  • Copy, reproduce, or clone this platform or its core functionality
  • Create derivative works based on WildflowerFinder's concept or design
  • Reverse engineer, decompile, or extract the source code
  • Use our branding, logo, name, or visual identity
  • Scrape, harvest, or collect data from this platform
  • Replicate the AI-powered wildflower identification concept for commercial purposes
  • Use any content for training AI/ML models without permission

8. International Protection

This intellectual property is protected under the Australian Copyright Act 1968, the Berne Convention for the Protection of Literary and Artistic Works, and applicable international intellectual property treaties. Unauthorized use may result in legal action in any jurisdiction where infringement occurs.

9. Enforcement

We actively monitor for intellectual property infringement. Violations will be pursued to the fullest extent of the law, including but not limited to: cease and desist orders, DMCA takedown notices, and civil litigation for damages. Please read carefully before uploading photos

10. Content License Grant

By uploading photos to WildflowerFinder, you grant Shades of April and WildflowerFinder a perpetual, worldwide, non-exclusive, royalty-free, transferable license to:

  • Display your photos on the WildflowerFinder platform and associated social media
  • Use your photos in marketing, promotional materials, and advertising
  • Include your photos in printed materials, books, calendars, and publications
  • Feature your photos on merchandise, products, and commercial goods
  • Sublicense your photos to partners, retailers, or distributors
  • Modify, crop, or edit photos as needed for these purposes

11. Your Rights & Ownership

You retain copyright ownership of your original photos. This license does not transfer ownership to us. You may continue to use, license, or sell your photos elsewhere. However, you cannot revoke the license granted to WildflowerFinder once photos are uploaded.

12. Your Warranties

By uploading photos, you confirm that:

  • You are the original photographer and copyright owner
  • The photos do not infringe on any third party's rights
  • No recognizable people appear in the photos (or you have their consent)
  • The photos were taken legally without disturbing protected flora
  • You have the right to grant this license

13. Attribution

While not required, we will make reasonable efforts to credit photographers when photos are used in products or publications. Attribution may include your display name as shown on your WildflowerFinder account.

14. Compensation

This is a royalty-free license. You will not receive payment for photos used by WildflowerFinder or Shades of April. By uploading, you waive any claim to compensation for uses permitted under this license.

Summary: By uploading photos, you allow us to use them on the platform and potentially in future Shades of April products (prints, calendars, merchandise, etc.) without payment. You keep ownership of your photos and can use them elsewhere.
